What is a Variance?
A Zoning Variance allows a property owner to infringe upon regulations set in the Zoning Code. Applicants must demonstrate relief from the Zoning Code is necessary in three areas:
(1) An unnecessary hardship would result from literal enforcement of the Zoning Code due to extraordinary or exceptional conditions, or by circumstances which are peculiar to the land, structure or building.
(2) Such extraordinary or exceptional conditions or circumstances do not apply generally to other property in the same zoning use district.
(3) If the Variance is granted, it will not cause substantial detriment to the public good or impair the purposes, spirit and intent of the Zoning Code or City's Comprehensive Plan.
